Properly (the "Service") is a pre-development property intelligence tool operated by Properly Tech Pty Ltd (ABN 20 699 601 397) ("we", "us", "our"), a company registered in Australia. The Service is a feasibility and planning guide only. Results produced by the Service are not a formal development approval, professional planning advice, financial advice, or a guarantee of DA approval.
By accessing or using the Service, you ("User") agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
All intellectual property in the Service — including the compliance engine, rule evaluation methodology, software, and the "Properly" brand — is owned exclusively by Properly Tech Pty Ltd and is protected by Australian and international intellectual property laws.
Users must not copy, reverse engineer, or use the Service to build any competing product or service, or misrepresent Service outputs as formal planning approvals.
By submitting information through the Service, you grant Properly Tech Pty Ltd a perpetual, royalty-free licence to use that data in anonymised form to improve the Service. We do not sell personally identifiable information to third parties.
Paid reports (Property Intelligence Report, Visual Site Analysis, Investment Numbers) are one-off digital products, priced in Australian dollars and inclusive of GST where applicable. Properly Tech Pty Ltd is registered for GST; a tax invoice is issued on purchase. Payment is required before the paid report is delivered. The free property check is provided at no cost.
Because reports are digital products delivered immediately, refunds are not generally available for change of mind once a report has been generated. However, if a report fails to generate, is not delivered, or is materially defective, contact us within 24 hours of purchase at the address below for a full refund. This policy operates in addition to — and does not limit — your rights under the Australian Consumer Law.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL where to do so would be unlawful. Where liability can be limited under the ACL, our liability is limited (at our option) to re-supplying the service or paying the cost of re-supply.
Subject to the Australian Consumer Law and clause 8, the Service is provided "as is". Planning rules change frequently; results may not reflect the most current Territory Plan provisions. Results are indicative guidance only and must be independently verified with a registered town planner (and, for financial figures, a qualified financial or property adviser) before you rely on them.
Subject to clause 8 (Australian Consumer Law), and to the maximum extent permitted by law, Properly Tech Pty Ltd's total aggregate liability arising out of or in connection with the Service or any report is limited to the amount you paid for the relevant report (or, for the free service, AUD $0). Properly Tech Pty Ltd is not liable for any indirect, incidental, special or consequential loss, or loss of profit, opportunity or data, arising from use of the Service, except to the extent such liability cannot be excluded under the ACL.
These Terms are governed by the laws of the Australian Capital Territory, Australia, and you submit to the non-exclusive jurisdiction of the courts of the ACT.
